CPSC Clarifies Requirements of New Children’s Product Safety Laws Taking Effect in February
Guidance Intended for Resellers of Children’s Products, Thrift and Consignment Stores

WASHINGTON, D.C. - In February 2009, new requirements of the Consumer Product Safety Improvement Act (CPSIA) take effect. Manufacturers, importers and retailers are expected to comply with the new Congressionally-mandated laws. Beginning February 10, 2009, children’s products cannot be sold if they contain more than 600 parts per million (ppm) total lead. Certain children’s products manufactured on or after February 10, 2009 cannot be sold if they contain more than 0.1% of certain specific phthalates or if they fail to meet new mandatory standards for toys.

Under the new law, children’s products with more than 600 ppm total lead cannot lawfully be sold in the United States on or after February 10, 2009, even if they were manufactured before that date. The total lead limit drops to 300 ppm on August 14, 2009.

The new law requires that domestic manufacturers and importers certify that children’s products made after February 10 meet all the new safety standards and the lead ban. Sellers of used children’s products, such as thrift stores and consignment stores, are not required to certify that those products meet the new lead limits, phthalates standard or new toy standards.

The new safety law does not require resellers to test children’s products in inventory for compliance with the lead limit before they are sold. However, resellers cannot sell children’s products that exceed the lead limit and therefore should avoid products that are likely to have lead content, unless they have testing or other information to indicate the products being sold have less than the new limit. Those resellers that do sell products in violation of the new limits could face civil and/or criminal penalties.

When the CPSIA was signed into law on August 14, 2008, it became unlawful to sell recalled products. All resellers should check the CPSC Web site (www.cpsc.gov) for information on recalled products before taking into inventory or selling a product. The selling of recalled products also could carry civil and/or criminal penalties.

While CPSC expects every company to comply fully with the new laws resellers should pay special attention to certain product categories. Among these are recalled children’s products, particularly cribs and play yards; children’s products that may contain lead, such as children’s jewelry and painted wooden or metal toys; flimsily made toys that are easily breakable into small parts; toys that lack the required age warnings; and dolls and stuffed toys that have buttons, eyes, noses or other small parts that are not securely fastened and could present a choking hazard for young children.

Just getting started

Hi Friends-Family-Clients-Customers-Mothers, etc!

I've just been introduced to the world of blogging as an avenue to generate more business and spread the word about Andy & Eve: Luxury Children's Resale.

Let's call this my first approach at blogging about business.

Thus far, it seems quite simple, which scares me... am I doing it right? I would welcome any and all advice regarding blogging for business.

I am very excited to report that we have the date set for our next Open House. These open house events have been very fun to attend.

Here's the information sent out to my current client list...

Hi Friends,

I'm thrilled to report that after the addendum to this lead legislation, It looks like my clothing resale business will be okay. I may be making some minor adjustments to the store, but all in all, I hope to have a long and successful relationship with all of you! Thanks to all of you for your continued support and speaking out about the law.

That being said, many of you have asked when I will be again purchasing clothing. I will again be looking to restock beginning February 10th (the date the new legislation goes into effect.)


From this point until February 10th, I am listing TONS of inventory (specifically winter and Valentine's gear) on my ebay store. Take a look when you get a chance and check back often, as new items are added daily! (But remember, the prices are always better in store than online, so be happy you are local!)

I hope to have lots of online sales so that I will be able to purchase more and more clothing from all of you. Please help me spread the word about Andy & Eve's new online store... see the site location at my signature line below.

As per usual, the sooner you get it in, the better chance you have of selling before I could possibly have to stop purchasing and have my next Open House. I am specifically looking for girls and boys clothing (outfits) from size 2T all the way up, so if you have anything in these sizes, please bring it in! Of course, I'm always happy to look at other sizes, there are often 'gems' all over the size charts that I'm happy and eager to purchase.


Also, the time has come where I will start selecting clothing by seasons, so as of February 10th, I will be looking to purchase Spring clothing. Hang onto your winter gear, and I'll be ready for those later in the year.

Those of you that have sold with me in the past can vouch for the amazing prices I offer on your luxury and name brand children's clothing. You know that I am very picky, but that is always for YOUR benefit! So, come to me first, and do what you will with the rest.

As always, I also take items as donations. All proceeds from clothing purchased from my donation section benefits www.poemonline.org. A wonderful local postpartum depression support group that I am happy and honored to be on the Board of Directors of, as I myself am a two-time survivor of PPD.
